BoostPanda provides AI-powered communication solutions for dental practices, including:
- Voice assistant for phone calls
- Web chat automation
- WhatsApp business integration
- Appointment scheduling and management
- Patient communication automation
3. User Accounts and Registration
3.1 You must provide accurate, current, and complete information during registration.
3.2 You are responsible for maintaining the security of your account credentials.
3.3 You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Transmit spam, harassment, or inappropriate content
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to our systems
- Use the Service for any unlawful or fraudulent purposes
- Violate patient privacy laws (HIPAA, GDPR, etc.)
5. AI Service Limitations
5.1 Our AI services are designed to assist with routine communications and should not replace professional medical judgment.
5.2 While we strive for accuracy, AI responses may contain errors. You are responsible for reviewing and verifying all AI-generated content.
5.3 The Service is not intended for emergency medical situations.
6. Data and Privacy
6.1 Customer Data Ownership: You retain ownership of all patient data and communications processed through our Service.
6.2 Data Processing: We process data solely to provide the Service and in accordance with our Privacy Policy.
6.3 Compliance: We maintain HIPAA and GDPR compliance measures, but you remain responsible for ensuring your use of the Service complies with applicable healthcare regulations.
6.4 Data Security: We implement industry-standard security measures to protect your data.
7. Service Availability
7.1 We aim for 99.9% uptime but do not guarantee uninterrupted service.
7.2 We may perform scheduled maintenance with advance notice when possible.
7.3 We are not liable for service interruptions due to factors beyond our control.
8. Subscription and Payment Terms
8.1 Service fees are billed monthly in advance based on your selected plan.
8.2 All fees are non-refundable unless otherwise specified.
8.3 We may change pricing with 30 days' written notice.
8.4 Failure to pay may result in service suspension or termination.
9. Intellectual Property
9.1 The Service and its technology are proprietary to BoostPandaAI.
9.2 You grant us a limited license to use your data solely to provide the Service.

10. Limitation of Liability
10.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10.2 OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
10.3 Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so these limitations may not apply to you.
11. Indemnification
You agree to indemnify and hold us harmless from any claims arising from your use of the Service or violation of these Terms.
12. Termination
12.1 Either party may terminate this agreement with 30 days' written notice.
12.2 We may terminate immediately for breach of these Terms.
12.3 Upon termination, we will provide you with your data in a standard format for 30 days.
13. Modifications to Terms
We may modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance.
14. Governing Law and Disputes
14.1 These Terms are governed by the laws of Delaware, United States.
14.2 Any disputes shall be resolved through binding arbitration in Delaware, except for intellectual property claims which may be brought in state or federal courts.
14.3 You consent to the jurisdiction of courts in Delaware, United States for any matters not subject to arbitration.

16. Severability
